Employment & Industrial Law​

Extensive experience in all aspects of employment and industrial law, having practised in this area of law since 2006, coming from the old Workplace Relations legislation, through to Workchoices and then under the Fair Work Act.  This includes:

  • Appearing before the Fair Work Commission in relation to Applications for Unfair Dismissal, General Protections claims and interlocutory matters relating to Out-of-Time applications;
  • Advising on the drafting and assisting with the negotiations, bargaining with Union and registration of Enterprise Bargaining Agreements through the Fair Work Commission;
  • Registering the termination of Work place Agreements through the Fair Work Commission;
  • Advising and acting in Termination of Employment, Unfair Dismissal claims, General Protections dispute and breach of contract claims;
  • Advising in relation to Modern Award entitlements, the National Employment Standard and the Fair Work Act and Regulations;
  • Advising and acting in relation to Redundancy claims and Transfer of Employment;
  • Advising in relation to Injured Workers;
  • Advising and acting in Underpayment of Wages claims, unpaid Superannuation and Long Service Leave entitlements;
  • Drafting Employment Contracts, including Restraint of Trade deeds, Post-Employment Restraints, Individual Flexibility Agreements and Confidential Information agreements;
  • Providing advice, assistance and representation with respect to Bullying & Harassment claims.

Intellectual Property Law

Extensive experience in all aspects of Copyright, Trade mark registrations and protection of business reputation claims. This includes:

  • Acting for corporate clients in Supreme Court litigation for breach of Copyright in design drawings;
  • Advising on Subsistence of Copyright, Exploitation of Copyright. Infringement of Copyright, Moral Rights and Related Rights;
  • Advising on interlocutory relief for breach of Intellectual Property rights;
  • Advising and assisting clients with respect to the registration of Trade Marks, including searching of the Australian Trade Mark On-line Search System and providing advice on international registrations;
  • Drafting Cease & Desist letters with respect to Trade Mark infringement, common law passing-off actions and breaches of the Australian Competition and Consumer Act (Australian Consumer Law);
  • Advising in relation to Business Reputation & Misappropriation;
  • Drafting Confidentiality, Non-Disclosure and Restraint Deeds with respect to the usage of Intellectual Property;
  • Advising on the Assignment or Transmission of Intellectual Property rights;
  • Drafting Social Media Policies, Software Licensing Agreements & Assignments.
 

Wills and EstateS PLANNING

Many years of experience in estate planning, Wills, Powers of Attorney, Enduring Guardian, Advance Care Directives and Succession Law.
This includes:

  • Advising on and drafting Last Will & Testament documents, Powers of Attorney, Appointment of Enduring Guardian and Advance Care Directives;
  • Advising in relation to Estate Planning and Succession Planning;
  • Advising in relation to Testamentary Incapacity;
  • Advising in relation to the Succession Act 2006 (NSW) and related claims, drafting Deeds of Family Arrangement.

Probate

Practical experience in assisting with the administration of Estates. This includes:

  • Advising & acting in relation to Estates;
  • Applying for Formal Administration of the Estate;
  • Advising in relation to the Intestacy Rules;
  • Applying for Probate through the Supreme Court of New South Wales, dealing with Trustees & Executors;
  • Facilitating Distribution of the Estate to Beneficiaries.

Civil Litigation

Many years of practical experience in the Local Court, District Court and Supreme Courts and Tribunals. This includes:

  • Advising on and appearing in the Local Court, District Court and Supreme Court of New South Wales jurisdictions in relation to various matters including Damages Claims, Personal Injury Claims, Money Claims (Debt Recovery);
  • Appearing in various Tribunals such as the New South Wales Civil and Administrative Tribunal (NCAT, and its predecessors);
  • Drafting Statements of Claims, Pleadings, Defence, Cross-Claims, Affidavits and Interlocutory Applications such as Transfer of Proceedings and Jurisdiction claims;
  • Appearing for Mentions, Pre-Trial Reviews, Status Conferences, Mediations, Directions Hearings, Return of Subpoena, Interim Hearings & Final Hearings;
  • Advising & acting in relation to Defamation Claims;
  • Advising & acting in relation to Uncollected Goods;
  • Advising & acting in relation to Bankruptcy;
  • Advising & acting in relation to Victims Compensation;
  • Advising on and acting in relation to the Civil Liability Act 2002 (NSW)
  • Drafting Letters of Demand & related Enforcement proceedings
